Sir George Lewls, representing Lady Randolph Churchill and others, announced that the Public Proseutor had taken up the case and had requested him to conduct the prosecution for the Treasury Department.

Mrs. Moreton Frewen was called as a witness and testified to a conversation which she had with the Hon. Arthur Cadogan, brother of Earl Cadogan, the Lord Lieutenant of Ireland, who is said to have introduced some of the complainants to "Captain" Crulckshank. This conversation, Mrs. Frewen said, was in regard to a syndicate formed to construct a branch line to connect two rail roads in America and promises were held out whIch induced her to make investments.

Upon cross-examination, the witness admitted saying to "Captain" Cruickshank: :You know all our family are great gamblers, and If the speculation comes off we shall be delighted, and If it does not you will never hear an unkind word from us."

The defense proposed to read a letter written by Lady Randolph Churchill to Cruickshank, but the reading was postponed until Lady Randolph testifies.

Upon re-examination, Mrs. Moreton Frewen said the Hon. Arthur Cadogan had not told her Cruickshank was an undischarged bankrupt with debts amounting to $60,000. Eventually the prisoner was again remanded.
